Last updated: October 22, 2026

These Terms of Use (“Terms”) govern your access to and use of the website firstcallsocial.com and related pages (the “Site”) operated by FIRSTCALL SOCIAL LLC, a Wyoming limited liability company (“FirstCall,” “we,” “us,” or “our”), with its principal place of business at 5030 Champion Blvd, Suite G11-121, Boca Raton, Florida 33496. By accessing or using the Site, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not use the Site.

1. Acceptance of Terms

Your use of the Site constitutes your acceptance of these Terms. We may update these Terms from time to time by posting a revised version on the Site with an updated “Last updated” date. Your continued use of the Site after any changes constitutes your acceptance of the revised Terms. Material changes will be highlighted or otherwise notified as appropriate.

2. Information Only; No Professional Advice

Content on the Site, including blog articles, case studies, pricing information, sample content, and other materials, is general information about marketing services. It is not legal, medical, compliance, regulatory, or professional advice. Nothing on the Site creates an attorney-client, advisor-client, or other professional relationship. You should consult your own attorney, compliance advisor, or other qualified professional regarding your specific obligations under applicable law, including laws governing advertising of addiction treatment, mental health, or telehealth services.

3. No Guarantees of Results

Any case study figures, results, testimonials, or examples describe past performance for specific clients under specific circumstances. They are not a promise, guarantee, or prediction of results for any other person or entity. Actual results will vary. FirstCall makes no guarantee of reach, followers, calls, leads, admissions, census, revenue, or any other outcome.

4. Intellectual Property

The text, design, logos, graphics, trademarks, service marks, and other content on the Site are owned by FirstCall or its licensors and are protected by United States and international copyright, trademark, and other intellectual property laws. You may share links to our pages for non-commercial reference purposes, but you may not copy, reproduce, distribute, modify, create derivative works from, publicly display, or use the Site’s content for any commercial purpose without our prior written permission. All rights not expressly granted are reserved.

5. Services Provided Under Separate Agreements

Our done-for-you organic social media management services are provided solely under a separate written Master Client Service Agreement, Order Form, Business Associate Agreement, and related documents. Nothing on the Site creates a contract for services, a partnership, joint venture, or any other binding obligation to provide services. All services are subject to the terms of those separate agreements. The Site is for informational and inquiry purposes only.

6. User Submissions and Acceptable Use

If you submit information through forms on the Site (including sample-week requests, partner inquiries, or client intake), you represent and warrant that the information is accurate, that you have the right to provide it, and that it does not contain any patient information, protected health information, or other prohibited content. You grant FirstCall a limited, non-exclusive, royalty-free license to use the information solely to respond to you and to perform any services you may later request under a separate agreement. You agree not to use the Site to transmit any unlawful, harmful, or infringing content, or to interfere with the Site’s operation.

7. Links to Third-Party Sites

The Site may contain links to third-party websites or resources. These links are provided for convenience only. We do not endorse and are not responsible for the content, privacy practices, or terms of any third-party sites. Your use of third-party sites is at your own risk and subject to their terms and policies.

8. Disclaimer of Warranties

THE SITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT. FIRSTCALL DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. YOUR USE OF THE SITE IS AT YOUR SOLE RISK.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FIRSTCALL’S TOTAL LIABILITY ARISING OUT OF OR RELATED TO THE SITE, THESE TERMS, OR YOUR USE OF THE SITE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO FIRSTCALL (IF ANY) IN THE THREE (3) MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED DOLLARS ($100). IN NO EVENT SHALL FIRSTCALL BE LIABLE FOR ANY INDIRECT, CONSEQUENTIAL, INCIDENTAL, SPECIAL, PUNITIVE, EXEMPLARY, OR LOST-PROFITS DAMAGES, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER THEORY, EVEN IF FIRSTCALL HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

10. Indemnification

You agree to indemnify, defend, and hold harmless FirstCall, its members, managers, officers, employees, and contractors from and against any and all claims, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to (a) your use of the Site, (b) your submissions or content, (c) your violation of these Terms, or (d) your violation of any law or the rights of any third party.

11. Termination

We may suspend or terminate your access to the Site at any time, with or without notice, for any reason, including if we believe you have violated these Terms. Upon termination, your right to use the Site ceases immediately. Provisions that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, indemnification, and governing law) shall survive.

12. Governing Law, Venue, Jury Waiver, and Attorneys’ Fees

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles. The exclusive venue for any dispute arising out of or relating to these Terms or the Site is the state or federal courts located in Palm Beach County, Florida. 13. Miscellaneous

These Terms, together with our Privacy Policy, constitute the entire agreement between you and FirstCall regarding the Site and supersede all prior agreements. If any provision of these Terms is held to be unenforceable, the remaining provisions shall continue in full force and effect. Our failure to enforce any right or provision shall not constitute a waiver. These Terms do not create any partnership, joint venture, employment, or agency relationship.
